Frozen Semen and Embryo Storage Contract

2. Semen and Embryo Storage: The Storage Facility agrees to provide storage services for the frozen semen and embryo(s) owned by the Owner. The storage period will commence on the Effective Date and continue for a period of one calendar year unless terminated earlier as per the terms of this agreement.

3. Fees and Payment: In consideration for the storage services, the Owner agrees to pay the Storage Facility the appropriate fees specified below:

Frozen Semen Fees: 1-5 Doses: $110.00 per year 6-25 Doses: $230.00 per year 26+ Doses: $310.00 per year

Embryo Fees: $115.00 per embryo per year Payment will be due on January 1st of every year that the storage facility is being utilized by the owner of the semen/embryo(s).

4. Conditions of Storage: The Owner represents and warrants that they have legal ownership and the right to store the semen and/or embryo(s). The Owner shall provide the Storage Facility with all necessary documentation related to the stored material. *Please note that all frozen semen remains the property of the stallion client unless it was purchased outright without a contract. If frozen semen has been shipped to Fen Vet Equine Reproduction with permission to store it, a completed and up-to-date contract must be on file in order to use or relocate the semen. Use or transfer of stored semen without proper documentation or authorization is strictly prohibited.

The Storage Facility agrees to maintain appropriate conditions for the storage of frozen semen and/or embryos, including but not limited to temperature control, and security.

5. Access to Stored Material: The Owner shall have the right to access the stored Semen/Embryos with written 48 hour notice to the Storage Facility during regular business hours (Monday - Friday, 8am - 5pm). The Owner shall bear any costs associated with the retrieval process.

6. Termination: Either party may terminate this agreement with written notice to the other party. Upon termination, the Owner shall be responsible for any outstanding fees and retrieval costs.

7. Limitation of Liability:

The semen and/or embryos are insured, and the client agrees to provide a copy of the insurance policy prior to storage at the Fen Vet Equine Reproduction Facility.
The semen and/or embryos are not insured, and the client agrees to accept full responsibility for any loss, damage, or deterioration while stored at Fen Vet Equine Reproduction.

The client waives all liability and any right to sue, and agrees to hold harmless Fen Vet Equine Reproduction, its staff, agents, and affiliates for any loss, damage, or deterioration of the stored semen and/or embryos, regardless of cause.

8. Entire Agreement: This agreement constitutes the entire understanding between the parties and supersedes any prior agreements or understandings, whether written or oral.
